This session will provide an overview of the applicable federal and state laws relating to data privacy and security for schools, and school administrators and professionals will learn about the key requirements to comply with said laws. The presentation will then discuss various data breaches and resulting lawsuits affecting school districts and Ed-tech vendors, and lessons that can be learned to protect against a breach and limit exposure to a lawsuit.

As a member of Robbins Schwartz’s Data Privacy team, Logan represents school districts, colleges, and educational technology companies in matters related to student privacy and data security. She regularly advises school districts on privacy considerations and compliance requirements associated with the use of educational technology platforms, and she is experienced in negotiating data privacy agreements and education-related service agreements on behalf of schools and organizations. Logan also advises K-12 and higher education clients on data security compliance and notification obligations after a data security breach event.

Matt represents school districts, colleges, and educational technology companies in matters relating to student records and data privacy. Matt regularly drafts and negotiates data privacy agreements, software license agreements, and other service agreements that comply with applicable federal and state privacy laws and regulations while simultaneously protecting his client’s interests. He was part of a team of Robbins Schwartz attorneys that drafted the Illinois addendum to the National Data Privacy Agreement and frequently advises clients on the evolving legal landscape for education privacy matters and risks associated with data breaches or ransomware attacks.
