On or before the beginning of the 2027-2028 school year, each school board must adopt and implement a wireless communication device policy that, at a minimum, prohibits students from using wireless communication devices during school time, subject to statutory exceptions.
The policy must address device storage, uniform enforcement, developmentally appropriate and trauma-informed implementation, and an alternative when a violation ordinarily would require a parent or guardian to retrieve the device but the parent or guardian cannot appear in person.
Required exceptions include use needed to fulfill an IEP, Section 504 plan, medical order, or other written accommodation; use determined necessary for an English learner to access learning materials; use determined necessary on a case-by-case basis for a student caregiver; and use required by other State or federal law. Districts may also permit use for educational purposes, emergencies, and, at district discretion, high school lunch and passing periods.
Districts may not enforce the policy through fees, fines, suspensions, expulsions, or deployment of a school resource officer or law enforcement officer, although this limitation does not prevent discipline when use of the device constitutes separate gross disobedience or misconduct.
Development of the policy must include input from the teachers’ collective bargaining representative, if any, administrators, and parents or guardians; student input is encouraged. The policy must be reviewed at least once every 3 years with stakeholder input.
The policy must be posted on the district’s publicly accessible website and provided annually to parents, guardians, and school personnel, including new employees and substitute teachers. School boards and personnel receive specified immunity for damage to devices stored in good faith under the policy.
