Right to Privacy in the Work Place

Employers are prohibited from requesting, requiring, or coercing any employee or prospective employee to provide a user name and password or any password or other related account information in order to gain access to the employee’s or prospective employee’s personal online account or to demand access in any manner to an employee’s or prospective employee’s personal online account. Employers are not prohibited from maintaining workplace policies governing the use of the employer’s electronic equipment, including internet/social networking/email use, and are further not prohibited from monitoring the usage of the employer’s electronic equipment (without requesting or using any employee’s to provide any password in order to gain access to the employee’s personal account).
